2. Aceptación de los Términos

Al crear una cuenta, acceder o utilizar Ping, usted confirma que:

• Tiene al menos 18 años de edad.
• Ha leído, comprendido y acepta estar legalmente vinculado por estos Términos y Condiciones.
• Acepta nuestra Política de Privacidad y Política de Cookies.
• Tiene capacidad legal para celebrar contratos vinculantes en su jurisdicción.
• No está prohibido de recibir servicios bajo las leyes aplicables.

3. Descripción del Servicio

Ping es una plataforma de citas que permite a los usuarios crear perfiles personales, descubrir otros usuarios mediante Bluetooth Low Energy (BLE), interactuar mediante mensajes y funciones de conexión. El servicio se ofrece en modalidad freemium.

3.1 Funciones básicas (gratuitas)

• Creación de perfil personal con fotos y descripción
• Visualización de perfiles de usuarios cercanos
• Número limitado de likes o conexiones diarias
• Mensajes básicos con usuarios con conexión mutua

3.2 Funciones premium (de pago)

• Likes ilimitados
• Ver quién ha visitado tu perfil
• Boost para mayor visibilidad
• Filtros avanzados de búsqueda
• Mensajes sin restricciones
• Eliminar publicidad (si aplica)

4. Registro y cuenta de usuario

4.1 Requisitos de registro

Para utilizar la aplicación, deberá crear una cuenta con información precisa, completa y actualizada. SER MAYOR DE 18 AÑOS es un requisito obligatorio e inmodificable. Cualquier usuario menor de 18 años será identificado y su cuenta será eliminada inmediatamente. Se prohíbe además:

• Crear una cuenta siendo menor de 18 años.
• Registrarse con información falsa o engañosa.
• Crear múltiples cuentas o cuentas en nombre de terceros sin autorización.
• Usar la aplicación si ha sido previamente suspendido o baneado por nosotros.

4.2 Seguridad de la cuenta

Usted es responsable de mantener la confidencialidad de sus credenciales. Debe notificarnos de inmediato ante cualquier uso no autorizado de su cuenta en security@ping-dating.com. No nos hacemos responsables por pérdidas derivadas de accesos no autorizados causados por negligencia del usuario.

4.3 Verificación de identidad

TODOS LOS USUARIOS DEBEN SER MAYORES DE 18 AÑOS. Durante el registro, se le solicitará verificar su edad mediante uno de los siguientes métodos:

• Verificación por número de teléfono
• Verificación facial mediante selfie e IA de detección de edad
• Verificación de documento de identidad (pasaporte, licencia de conducir, DNI)

Si la verificación indica que es menor de 18 años, su cuenta será inmediatamente desactivada sin opción de apelación. Podemos requerir verificación de identidad adicional en cualquier momento para garantizar la seguridad de la plataforma y el cumplimiento con regulaciones como COPPA y similares.

5. Contenido del usuario

5.1 Propiedad del contenido

Usted conserva la titularidad de todo el contenido que publique (fotos, textos, videos). Al publicarlo, nos otorga una licencia mundial, no exclusiva, libre de regalías, sublicenciable y transferible para usar, reproducir, distribuir, modificar y mostrar dicho contenido únicamente con el fin de operar y mejorar el servicio.

5.2 Contenido prohibido

Está estrictamente prohibido publicar contenido que:

• Sea sexualmente explícito, pornográfico o involucre menores de edad.
• Contenga desnudez no consentida o imágenes íntimas de terceros sin su consentimiento.
• Sea violento, amenazante, acosador o discriminatorio.
• Infrinja derechos de propiedad intelectual de terceros.
• Contenga información falsa o engañosa destinada a defraudar a otros usuarios.
• Promueva actividades ilegales, incluidas prostitución, tráfico de personas o drogas.
• Contenga virus, malware u otro código malicioso.
• Sea contenido de spam o publicidad no autorizada.
• Promueva marcas o servicios de la competencia directa.

5.3 Moderación de contenido

Nos reservamos el derecho de eliminar, sin previo aviso, cualquier contenido que consideremos que viola estos Términos o que resulte dañino para los usuarios o la plataforma. Contamos con mecanismos de denuncia para que los usuarios puedan reportar contenido inapropiado.

6. Suscripciones y pagos

6.1 Planes de suscripción

Ofrecemos planes de suscripción mensual y anual. Los precios se muestran en la aplicación y pueden variar según la región. Todos los precios incluyen los impuestos aplicables según la jurisdicción del usuario.

6.2 Renovación automática

Las suscripciones se renuevan automáticamente al finalizar cada período, a menos que el usuario cancele al menos 24 horas antes de la fecha de renovación. La cancelación puede realizarse desde la configuración de la cuenta, o directamente desde App Store (iOS) o Google Play (Android).

6.3 Reembolsos

• Compras en iOS: según la política de reembolsos de Apple (support.apple.com/billing).
• Compras en Android: según la política de Google Play.
• Compras directas en web: reembolso completo dentro de los primeros 14 días si el servicio premium no ha sido utilizado de forma significativa.
• No se realizan reembolsos proporcionales por cancelaciones anticipadas.

6.4 Cambios de precio

Nos reservamos el derecho de modificar los precios. Los cambios se notificarán con al menos 30 días de antelación. El uso continuado tras la notificación constituye aceptación del nuevo precio.

7. Conducta del usuario

Los usuarios se comprometen a utilizar la aplicación de buena fe. Se prohíbe:

• Acosar, amenazar o intimidar a otros usuarios.
• Solicitar dinero u otras prestaciones económicas a otros usuarios.
• Engañar o estafar a otros usuarios con fines económicos o personales.
• Compartir información de contacto personal de otros usuarios sin su consentimiento.
• Intentar vulnerar la seguridad de la plataforma o acceder a datos de otros usuarios.
• Usar bots, scripts u otros medios automatizados para interactuar con la plataforma.
• Usar la plataforma con fines comerciales no autorizados.
• Discriminar a usuarios por género, orientación sexual, raza, religión, nacionalidad o discapacidad.

8. Seguridad y verificación de edad

Tomamos la seguridad de nuestra comunidad muy en serio. Implementamos las siguientes medidas:

• Verificación de número de teléfono durante el registro.
• Verificación de identidad adicional mediante selfie con IA y/o documento oficial.
• Sistema de reportes y bloqueos disponible para todos los usuarios.
• Revisión manual de cuentas sospechosas por nuestro equipo de confianza y seguridad.
• Tecnología de detección automática de contenido prohibido (incluyendo detección de CSAM).
• Cumplimiento con el National Center for Missing & Exploited Children (NCMEC) para reportar material ilegal.

No podemos garantizar la autenticidad de todos los perfiles ni la seguridad total de las interacciones fuera de la plataforma. Recomendamos tomar precauciones al reunirse con personas conocidas online.

9. Propiedad intelectual

Todos los derechos de propiedad intelectual sobre la aplicación, incluyendo el diseño, logotipos, código fuente, texto, gráficos e interfaces, son propiedad exclusiva de Ping Experiences LLC o de sus licenciantes. Queda prohibida cualquier reproducción, distribución o uso no autorizado. El nombre "Ping" y su logotipo son marcas comerciales registradas o en proceso de registro de Ping Experiences LLC.

10. Limitación de responsabilidad

En la máxima medida permitida por la ley aplicable, Ping Experiences LLC no será responsable por:

• Daños indirectos, incidentales, especiales, consecuentes o punitivos.
• Pérdida de datos, oportunidades de negocio, reputación o ganancias.
• Conducta de terceros usuarios, incluidos daños físicos o psicológicos derivados de encuentros con otros usuarios.
• Interrupciones del servicio, errores técnicos o pérdida de información.
• Acceso no autorizado a su cuenta si no tomó las precauciones de seguridad adecuadas.

En ningún caso nuestra responsabilidad total excederá el monto pagado por el usuario en los últimos 12 meses, o USD $100 si no se ha realizado ningún pago.

11. Indemnización

El usuario acepta defender, indemnizar y eximir de toda responsabilidad a Ping Experiences LLC, sus directivos, empleados, agentes y socios, frente a cualquier reclamación derivada de: (a) el uso o acceso al servicio; (b) la violación de estos Términos; (c) la violación de derechos de terceros; o (d) cualquier contenido publicado en la plataforma.

12. Suspensión y terminación

Nos reservamos el derecho de suspender o eliminar su cuenta, con o sin previo aviso, si:

• Viola cualquier disposición de estos Términos.
• Su conducta es perjudicial para otros usuarios o para la plataforma.
• Proporciona información falsa o engañosa.
• Es menor de 18 años.
• Existen razones de seguridad que lo justifiquen.

En caso de terminación por causa justificada, no se realizarán reembolsos de suscripciones activas. El usuario puede solicitar la eliminación de su cuenta en cualquier momento desde la configuración de la aplicación.

13. Ley aplicable y jurisdicción

Estos Términos se rigen por las leyes de los Estados Unidos de América, sin perjuicio de sus disposiciones sobre conflicto de leyes. Para usuarios de la Unión Europea, nada en estos Términos limitará sus derechos como consumidor bajo la legislación de la UE. Cualquier disputa se resolverá primero mediante negociación amistosa y, de no resolverse, mediante arbitraje vinculante bajo las reglas de la American Arbitration Association (AAA).

14. Modificaciones de los Términos

Nos reservamos el derecho de modificar estos Términos en cualquier momento. Las modificaciones entrarán en vigor al ser publicadas. Notificaremos a los usuarios mediante correo electrónico o notificación push sobre cambios materiales con al menos 30 días de antelación. El uso continuado de la aplicación tras la notificación constituye aceptación de los nuevos Términos.

15. Disposiciones generales

• Integridad del acuerdo: Estos Términos, junto con la Política de Privacidad y Política de Cookies, constituyen el acuerdo completo entre el usuario y Ping Experiences LLC.
• Divisibilidad: Si alguna disposición se considera inválida o inaplicable, el resto permanecerá en pleno vigor.
• Renuncia: La falta de ejercicio de cualquier derecho no constituye una renuncia a dicho derecho.
• Comunicaciones: Las comunicaciones oficiales se realizarán al correo electrónico registrado en la cuenta o mediante notificaciones en la aplicación.
• Transferencia: No puede ceder sus derechos u obligaciones sin nuestro consentimiento previo por escrito.

By creating an account, accessing or using Ping, you confirm that:

• You are at least 18 years of age.
• You have read, understood and agree to be legally bound by these Terms and Conditions.
• You accept our Privacy Policy and Cookie Policy.
• You have the legal capacity to enter into binding contracts in your jurisdiction.
• You are not prohibited from receiving services under applicable laws.

3. Description of Service

Ping is a dating platform that allows users to create personal profiles, discover other users via Bluetooth Low Energy (BLE), and interact through messages and connection features. The service is offered on a freemium basis.

3.1 Basic features (free)

• Personal profile creation with photos and description
• View profiles of nearby users
• Limited number of daily likes or connections
• Basic messaging with mutually matched users

3.2 Premium features (paid)

• Unlimited likes
• See who visited your profile
• Boost for greater visibility
• Advanced search filters
• Unrestricted messaging
• Remove advertising (if applicable)

4. User Registration and Account

4.1 Registration Requirements

To use the application, you must create an account with accurate, complete and up-to-date information. BEING 18 YEARS OR OLDER is a mandatory and non-negotiable requirement. Any user under 18 will be identified and their account deleted immediately. The following is also prohibited:

• Creating an account if you are under 18 years of age.
• Registering with false or misleading information.
• Creating multiple accounts or accounts on behalf of third parties without authorization.
• Using the application if you have been previously suspended or banned by us.

4.2 Account Security

You are responsible for maintaining the confidentiality of your credentials. You must notify us immediately of any unauthorized use of your account at security@ping-dating.com. We are not liable for losses resulting from unauthorized access caused by user negligence.

4.3 Identity Verification

ALL USERS MUST BE 18 YEARS OR OLDER. During registration, you will be asked to verify your age using one of the following methods:

• Phone number verification
• Facial verification via selfie and AI age detection
• Identity document verification (passport, driver's license, national ID)

If verification indicates you are under 18, your account will be immediately deactivated with no option to appeal. We may require additional identity verification at any time to ensure platform safety and compliance with regulations such as COPPA and similar laws.

5. User Content

5.1 Content Ownership

You retain ownership of all content you post (photos, text, videos). By posting it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, modify and display such content solely for the purpose of operating and improving the service.

5.2 Prohibited Content

It is strictly prohibited to post content that:

• Is sexually explicit, pornographic or involves minors.
• Contains non-consensual nudity or intimate images of third parties without consent.
• Is violent, threatening, harassing or discriminatory.
• Infringes the intellectual property rights of third parties.
• Contains false or misleading information intended to defraud other users.
• Promotes illegal activities, including prostitution, human trafficking or drugs.
• Contains viruses, malware or other malicious code.
• Is spam or unauthorized advertising.
• Promotes brands or services of direct competitors.

5.3 Content Moderation

We reserve the right to remove, without prior notice, any content we deem to violate these Terms or harmful to users or the platform. We provide reporting mechanisms so users can flag inappropriate content.

6. Subscriptions and Payments

6.1 Subscription Plans

We offer monthly and annual subscription plans. Prices are shown in the application and may vary by region. All prices include applicable taxes based on the user's jurisdiction.

6.2 Automatic Renewal

Subscriptions automatically renew at the end of each period unless the user cancels at least 24 hours before the renewal date. Cancellation can be done from the account settings, or directly from the App Store (iOS) or Google Play (Android).

6.3 Refunds

• iOS purchases: according to Apple's refund policy (support.apple.com/billing).
• Android purchases: according to Google Play's policy.
• Direct web purchases: full refund within the first 14 days if the premium service has not been significantly used.
• No proportional refunds are made for early cancellations.

6.4 Price Changes

We reserve the right to modify subscription prices. Changes will be notified at least 30 days in advance. Continued use of the application after notification constitutes acceptance of the new price.

7. User Conduct

Users agree to use the application in good faith. The following is prohibited:

• Harassing, threatening or intimidating other users.
• Requesting money or other economic benefits from other users.
• Deceiving or defrauding other users for economic or personal gain.
• Sharing personal contact information of other users without their consent.
• Attempting to breach the platform's security or access other users' data.
• Using bots, scripts or other automated means to interact with the platform.
• Using the platform for unauthorized commercial purposes.
• Discriminating against users based on gender, sexual orientation, race, religion, nationality or disability.

8. Safety and Age Verification

We take the safety of our community very seriously. We implement the following measures:

• Phone number verification during registration.
• Additional identity verification via AI selfie and/or official document.
• Reporting and blocking system available to all users.
• Manual review of suspicious accounts by our trust and safety team.
• Automatic detection technology for prohibited content, including CSAM detection.
• Compliance with the National Center for Missing & Exploited Children (NCMEC) for reporting illegal material.

We cannot guarantee the authenticity of all profiles or the total safety of interactions outside the platform. We recommend users take precautions when meeting people known online.

9. Intellectual Property

All intellectual property rights in the application, including design, logos, source code, text, graphics and interfaces, are the exclusive property of Ping Experiences LLC or its licensors. Any unauthorized reproduction, distribution or use is prohibited. The name "Ping" and its logo are trademarks registered or pending registration by Ping Experiences LLC.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Ping Experiences LLC shall not be liable for:

• Indirect, incidental, special, consequential or punitive damages.
• Loss of data, business opportunities, reputation or profits.
• Conduct of third-party users, including physical or psychological harm from encounters with other users.
• Service interruptions, technical errors or loss of information.
• Unauthorized access to your account if you did not take adequate security precautions.

In no event shall our total liability exceed the amount paid by the user in the last 12 months, or USD $100 if no payment has been made.

11. Indemnification

The user agrees to defend, indemnify and hold harmless Ping Experiences LLC, its officers, employees, agents and partners, from any claims arising from: (a) use of or access to the service; (b) violation of these Terms; (c) violation of third-party rights; or (d) any content posted on the platform.

12. Suspension and Termination

We reserve the right to suspend or delete your account, with or without prior notice, if:

• You violate any provision of these Terms.
• Your conduct is harmful to other users or the platform.
• You provide false or misleading information.
• You are under 18 years of age.
• There are security reasons that justify it.

In the event of termination for cause, no refunds will be made for active subscriptions. Users may request account deletion at any time from the application settings.

13. Applicable Law and Jurisdiction

These Terms are governed by the laws of the United States of America, without regard to conflict of law provisions. For European Union users, nothing in these Terms will limit your rights as a consumer under EU law. Any dispute will first be resolved through amicable negotiation and, if unresolved, through binding arbitration under the rules of the American Arbitration Association (AAA).

14. Modifications to the Terms

We reserve the right to modify these Terms at any time. Modifications take effect upon publication. We will notify users by email or push notification of material changes at least 30 days in advance. Continued use of the application after notification constitutes acceptance of the new Terms.

15. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the user and Ping Experiences LLC.
• Severability: If any provision is deemed invalid or unenforceable, the remainder will remain in full force.
• Waiver: Failure to exercise any right does not constitute a waiver of that right.
• Communications: Official communications will be sent to the email registered in your account or via in-app notifications.
• Assignment: You may not transfer your rights or obligations without our prior written consent.
